Terms of Service

Article 1 (Application)

1. These Terms apply to all relationships between us and users concerning the use of the Service.

2. Individual rules, guidelines, conditions for paid features and other rules that we publish on the Service ("Individual Rules") form part of these Terms. Where they differ from these Terms, the Individual Rules prevail unless they state otherwise.

3. Personal information is handled in accordance with our separate Privacy Policy.

Article 2 (Definitions)

• "User": anyone who views or uses the Service, including people without an account.
• "Account": a user's registration for using the Service.
• "Creator": a user who has applied in the manner we specify and whom we have allowed to post content.
• "Posted Content": videos, images, text and other information a user posts, sends or uploads to the Service.
• "Paid Features": features of the Service that involve payment (coins, subscriptions, series passes, creator memberships and similar).

Article 3 (Age Restriction and Eligibility)

1. The Service contains adult content. You may use the Service only if you are at least 18 years old and have reached the age of majority under the laws of the country or region where you live (if that age is higher than 18). Anyone who does not meet these conditions may not view or use the Service.

2. You are responsible for confirming that accessing and viewing the Service does not violate the laws of the country or region where you live. We may restrict use from particular countries or regions to comply with law or for other reasons.

3. If we determine that a user has violated this Article, we may suspend the user's use or delete the account without prior notice.

Article 4 (Accounts)

1. You can register an account with a phone number, email address, Google account, X account or another method we specify.

2. You must keep your registration information accurate and up to date and manage your account at your own responsibility. You may not transfer, lend or share your account with others.

3. We are not responsible for damage caused to you by unauthorized use of your account, except where it is caused by our intent or negligence.

4. We may assign a public username where needed to operate the Service.

Article 5 (Trial Operation and Paid Features)

1. The Service is currently in a trial operation period. During this period we may change the content, specifications or scope of the Service, or suspend it temporarily, without prior notice.

2. The content, prices, payment methods, refunds and other conditions of Paid Features will be set out separately as Individual Rules and published on the Service when Paid Features become available.

3. For matters not covered by these Terms or the Individual Rules, or where their interpretation is unclear, we will make a reasonable determination in line with applicable law and the purpose of these Terms and announce it on the Service where necessary. You may contact us about any such determination, and we will respond in good faith.

Article 6 (Creators)

1. Anyone who wishes to post content as a Creator must apply in the manner we specify and be approved by us. We are not obliged to disclose the reasons for a review decision.

2. Creators must accurately declare, when applying and for each post, whether real people appear in the content. Creators who post content featuring real people must complete our identity verification (for example, by submitting a passport or a government-issued ID) and be approved by us.

3. Creators who post sexual content featuring real people must, at their own responsibility, comply with all applicable laws protecting performers. This includes concluding and explaining a written (or electronic) appearance contract with each performer, observing the waiting periods the law requires before filming and before publication, and responding to performers' cancellation and publication-stop requests.

4. Creators must confirm that all performers were at least 18 years old at the time of filming and gave valid consent to appearing and to publication, and must keep records of this. Creators must promptly provide these records to us on request.

5. As a rule, sales from Paid Features are shared 80% to the Creator and 20% to us. The calculation method, payment timing, fees, tax treatment and other conditions will be set out in Individual Rules when Paid Features become available.

6. To the extent needed to operate the Service, we may review Posted Content, decide its display order, set or replace cover images, and hide or remove it.

Article 7 (Rights in Posted Content)

1. Copyright and other rights in Posted Content belong to the user who posted it or to the legitimate rights holder.

2. You warrant that you hold all rights needed to post your Posted Content and that it does not infringe the rights of any third party.

3. You grant us a free, worldwide, non-exclusive licence to use your Posted Content (including reproducing, converting, transcoding, creating thumbnails, cover images and previews, making it available to the public, displaying it, and showing it in share previews) for the purposes of providing, operating, improving and promoting the Service. This licence continues after the content is deleted for a reasonable period needed for backups, legal compliance and dispute handling.

4. You agree not to exercise moral rights against us in respect of uses within the scope of the preceding paragraph.

5. Rights in content on the Service and in the Service's design belong to us or the legitimate rights holders. Except by the means the Service provides, you may not download, copy, repost or redistribute them, or use them through mirror sites, framing or similar methods. Ordinary links to pages of the Service and sharing through the Service's share feature are not restricted.

Article 8 (Prohibited Conduct)

When using the Service, you must not:

• violate applicable laws, including the laws of the country or region where you live, or engage in conduct related to crime;
• post, send or request content in which a person under 18 appears, or content that depicts or presents a person under 18 as a sexual object (whether real or fictional, including any person or character presented or implied to be under 18);
• engage in child prostitution, child sexual abuse material or any other conduct harmful to minors;
• post content that violates applicable obscenity laws (including content in which genitals are not appropriately obscured);
• post sexual content without the consent of the performers or people depicted, voyeuristic recordings, private sexual images (so-called revenge porn), or synthetic or edited content that sexually depicts a real person without their consent (such as deepfakes);
• post content that violates laws protecting performers or other applicable laws;
• infringe the copyright, trademark, portrait rights, privacy, reputation or other rights or interests of others;
• post violent, threatening, harassing or discriminatory content, or encourage self-harm or harm to others;
• solicit prostitution, illegal drugs or meetings, or engage in similar conduct;
• steer others to money transfers or transactions outside the Service without our approval;
• register false information, impersonate others, or make a false declaration about whether real people appear in content;
• gain unauthorized access, exploit vulnerabilities, access the Service automatically with bots or scrapers, or place an excessive load on the Service;
• obtain, copy or redistribute content from the Service by means other than those the Service provides;
• provide benefits to, or otherwise be involved with, anti-social forces (organized crime groups and similar);
• otherwise interfere with the operation of the Service, or engage in conduct that we reasonably determine to be inappropriate in light of the law and the purpose of these Terms.

Article 9 (Reports and Removal Requests)

1. To report content that violates these Terms or infringes rights, or for a performer's own request to remove content or stop its publication, please use the Service's report function (where available) or contact support@yellowfruit.blog.

2. We will review the request and promptly take necessary measures in accordance with the law. We may ask the requester for additional information or identity verification.

3. If a person or company informs us that they hold the copyright or other rights in content on the Service, we may, after checking the notice, remove or hide the content first in order to protect the rights holder. The poster may object to this measure by contacting us.

Article 10 (Measures We May Take)

1. If a user violates these Terms, or if we reasonably determine that there is a risk of a violation, we may, without prior notice, hide or remove Posted Content, restrict features, suspend or delete the account, or take other necessary measures.

2. We may cooperate with investigative and other public authorities where required by law.

3. We are not liable for damage caused to a user by measures under this Article, except where caused by our intent or gross negligence.

Article 11 (Changes, Interruption and Termination of the Service)

1. We may interrupt all or part of the Service for maintenance, failures, natural disasters or other unavoidable reasons.

2. We may end all or part of the Service after giving reasonable advance notice on the Service.

Article 12 (Account Deletion)

1. You can request deletion of your account from the account settings. The account is disabled immediately and can be recovered during a 30-day grace period. After that period, the account is stored in a form that no longer identifies you (archived) and can no longer be recovered.

2. An account may not be deletable immediately, for example where there is an unused balance, an active Paid Feature, or unsettled Creator sales or subscribers. In that case, please contact us.

3. Even after an account is deleted, we may keep records needed to meet legal obligations, handle disputes and prevent fraud, as described in the Privacy Policy.

Article 13 (Disclaimer and Limitation of Liability)

1. We do not guarantee that the Service fits any particular purpose of yours, that it will always be available, or that it will be free of defects.

2. Disputes between users, or between a user and a third party, are to be resolved between the parties concerned. We will cooperate to a reasonable extent where necessary.

3. If a user suffers damage for reasons attributable to us, we are liable only for direct and ordinary damage actually incurred by the user, except where the damage is caused by our intent or gross negligence.

Article 14 (Personal Information)

We handle users' personal information in accordance with our separate Privacy Policy.

Article 15 (Changes to These Terms)

1. We may change these Terms where the change is in the general interest of users, or is reasonable in light of the need for the change, the appropriateness of the new content and other circumstances.

2. When we change these Terms, we will announce the change and its effective date on the Service or by another appropriate method a reasonable period before it takes effect.

Article 16 (Notices and Contact)

We give notices to users by displaying them on the Service, through its notification feature, or by sending them to registered contact details. Users should contact us at support@yellowfruit.blog.

Article 17 (Assignment)

1. You may not transfer or pledge your position or rights and obligations under these Terms to a third party without our prior consent.

2. If we transfer the business of the Service to a third party, we may transfer our position, rights and obligations under these Terms and users' information to the transferee.

Article 18 (Severability)

If any provision of these Terms, or part of one, is held invalid or unenforceable by law, the remaining provisions remain in full effect.

Article 19 (Exclusion of Anti-Social Forces)

You represent and warrant that you are not, and will not become, a member of an organized crime group or other anti-social force. If you breach this, we may delete your account immediately.
